The Canadian Association of University Teachers (CAUT) condemns the Alberta government’s latest abuse of the notwithstanding clause on legislation affecting trans youth, overriding the Charter of Rights and Freedoms

“The Alberta government’s actions infringe on constitutional rights, intrude upon the institutional autonomy of the province’s universities, and circumvent their governance processes,” said CAUT executive director David Robinson. 

On Wednesday, the province passed laws restricting the use of trans students’ names and pronouns in schools, banning trans girls from female amateur sports, and prohibiting gender‑affirming medical care for youth under 16.  

The so-called Fairness and Safety in Sport Act also undermines institutional autonomy, directing university boards to implement policies that compromise the dignity, privacy and equality rights of student athletes.  

“The Charter exists to protect the rights of all Canadians, especially the most vulnerable,” Robinson added. “CAUT stands with the labour movement, educators, health professionals and families in rejecting this abuse of power.” 

CAUT represents more than 75,000 academic staff at 130 universities and colleges across Canada.
