Article 26: Legal Non-Liability of Faculty Members and Librarians
26.1 The University agrees to indemnify and save harmless any faculty member or librarian for any damages assessed in a legal action arising out of the activities performed in the course of his or her employment including, but not limited to the performance of his or her duties in an administrative capacity (for example, as President, Dean, Chief Librarian or Department/Division Chair) or as a member of any decision-making or advisory committee or board (for example, Research Board, University Appeals Committee or Department Committee), except where recklessness or wilful neglect is established on the part of the faculty member or librarian.
26.2 The University agrees to pay the legal fees and expenses, court costs and damages which may arise from civil proceedings involving the matters set out above. The University agrees to pay the legal fees and expenses arising out of any criminal proceedings against a faculty member or librarian involving the matters set out above where the faculty member or librarian is discharged or acquitted.
26.3 The University agrees that should any faculty member or librarian, as a result of performing specified duties (as in 26.1), become involved in any litigation (as in 26.2) the faculty member or librarian can choose to be represented by the University’s legal counsel.
