Article 1: Definitions
- 1.1 The “Act”
- means “The University of Guelph Act. S.O.1964,” c.120 as amended by S.O. 1965, c. 136 and from time to time.
- 1.2 “Association”
- means the University of Guelph Faculty Association (UGFA) and any agents or officers duly elected or appointed to act on its behalf.
- 1.3 “Board”
- means the Board of Governors as provided for in The University of Guelph Act, 1964 and in any subsequent amendments.
- 1.4 “University”
- means the Board of Governors or the President, Vice-Presidents, senior administrators and any other duly appointed persons acting at any time or on behalf of the University of Guelph in their academic administrative capacity as more specifically delineated in the University of Guelph Act, 1964.
- 1.5 “Senate”
- means the Senate of the University of Guelph
- 1.6 “College”
- means one of the constituent academic colleges that are presently part of the University.
- 1.7 “Library”
- means the University of Guelph Library System.
- 1.8 “Academic Unit”
- means a University school, a school, a department or the Library established under S.4 of the Act.
- 1.9 “Agreement”
- means this Special Plan Agreement between the University of Guelph and the University of Guelph Faculty Association.
- 1.10 “Faculty Policies Handbook”
- means the Faculty Policies Handbook, University of Guelph, as amended and in effect on the date of this Agreement.
- 1.10.1 “Terms and Conditions”
- means the “Terms and Conditions of Employment for Professional Librarians”, University of Guelph, Revised edition, December 1979, as amended to April 1996.
- 1.11 “Faculty” or “Faculty members”
- means all those individuals holding probationary or tenured appointments, on either a full-time or part-time basis, together with those holding contractually limited appointments, at any of the ranks designated herein, namely, Professor, Associate Professor, Assistant Professor, Lecturer and Instructor. Contractually-limited faculty appointments will not normally be less than 12 months or more than 5 years. The University is committed to make all reasonable efforts to regularize any contractually limited appointments that provide more than 5 years of continuous employment.
- 1.12 “Librarian”
- means all those individuals holding probationary, or continuing appointments on either a full-time or limited appointment basis, together with those holding contractually limited appointments at any of the librarian levels, namely Assistant Librarian, Associate Librarian and Librarian, Contractually limited librarian appointments will not normally be less than 12 months and not more than 5 years. The University is committed to make all reasonable efforts to regularize any contractually limited appointments that provide more than 5 years of continuous employment.
- 1.13 “Day(s)”
- means calendar day(s) unless otherwise specified in particular articles of this Agreement.
- 1.14 “Parties”
- means the parties to the Agreement, that is, the University of Guelph and the University of Guelph Faculty Association.
- 1.15 “Written” or ”In writing”
- means handwritten, typewritten, printed or photocopied material documents.
- 1.16 “Department Committee” or ”College Committee”
- means the Department or College Tenure and Promotion Committee as described in the Faculty Policies Handbook, Section D, Parts 1 and 2.
- 1.17 “Academic Year”
- means the 365(6) days comprising the three academic semesters, commencing with the Spring Semester.
