Model Clause on Cancellation Fees for Contract Academic Staff


Entitlement


1.1   
All members shall receive a cancellation fee for work offered, whether written or verbal, if that work is subsequently cancelled by the employer.


Reason for Cancellation


2.1
Contracts may be cancelled only because of insufficient enrolment.1


Notice and Amount of Cancellation Fee


3.1
No contract may be cancelled on or after the first day of classes without full disbursement.

3.2
If the employer cancels a contract before the first day of classes, the employee shall receive a cancellation fee of 100% of the value of the contract.

3.3
If a contract which covers one or more courses is cancelled by the employer, a new contract shall be issued for the remaining work and the employee shall be compensated for the cancelled work according to 3.2.


Seniority and Right to Future Work


4.1   
If the work is cancelled, the member shall be credited with the seniority, experience and all other entitlements as if the contract has been fulfilled.

4.2
If the work is cancelled, the member shall be entitled to teach the section/course2 the next time it is offered by the institution subject to seniority.

Information for Association


5.1
The employer shall notify the association when a contract is cancelled, specifying enrollment information.
