Model Clause on the Bargaining Unit Status of Administrators

Any appointment of an administrator to an academic position shall be in accordance with the procedures for academic appointments in the collective agreement.

 Any administrator who held, or who was appointed to, an academic position at the time of appointment as an administrator and was excluded from the bargaining unit by virtue of their office shall, upon completion of their term of office, or resignation or termination, immediately return to their academic position as a full-time member of the bargaining unit.

Termination from an administrator position is not termination from an academic position. The latter may only follow the former, is procedurally distinct, and shall follow the relevant provisions of the collective agreement.

When an administrator returns to their academic position their terms and conditions shall be governed by the collective agreement without any loss of rights or entitlements.  Administrative stipends shall not be retained.

Planned hirings shall not be affected by the entry or re-entry of an academic administrator into the bargaining unit.

During the term of office of the administrator, the administrator’s home unit shall maintain its full complement of full-time tenured and tenure-track academic positions.

An administrator who does not hold an academic position is eligible to apply for an academic position.

An administrator shall be awarded tenure or promotion in academic rank only in accordance with the provisions of the collective agreement.
