Model Clause on Members’ Rights during Strikes by another Bargaining Unit¹

1
A member shall have the right to refuse to cross a picket line of another bargaining unit.

2
The exercise of this right shall not be considered a violation of this agreement, nor shall it be grounds for disciplinary action.

3
Members shall not perform the work of striking employees nor handle the work normally performed by other employees during any dispute between those employees and the employer.

4
The employer shall continue to pay the salary and benefits of any member who exercises their rights under this article.

Approved by the CAUT Council, November 2005.
Endnote
1. Portions of this clause may be invalidated by the legislation of some provinces; however, its presence in a collective agreement may provide a valuable guide for settling a dispute over the imposition of a penalty.
