Appendix J: Salary Re-Negotiation upon change from Term to Preliminary/Tenured Faculty Appointment Status WHEREAS the parties recognize that CUASA is the exclusive bargaining agent with exclusive bargaining rights to represent members who are in the CUASA bargaining unit as defined by the certificate of the Ontario Labour Relations Board dated June 18, 1975, as may be amended from time to time; 1. AND WHEREAS, the parties recognize that allowing term members to renegotiate their nominal salary under the circumstances described herein is a mutually agreeable exception to the above and does not prejudice the bargaining rights of the Association in any other way whatsoever; AND UNTIL such time as the parties agree to appropriate language for inclusion in Appendix E of the Collective Agreement; NOW THEREFORE, the parties agree as follows: 1. Notwithstanding Appendix E, paragraph 3.1(d), and the past practice of the parties, each term appointee granted a preliminary or tenured faculty appointment will be permitted to enter into negotiations with their Dean to determine an increase to their salary. 2. The ability to conduct such negotiations shall be effective as of November 15, 2005.
